What Is An AFFF Lawsuit?

An AFFF lawsuit is a legal action against the manufacturers and distributors of aqueous film-forming foam (AFFF), a firefighting foam containing perfluoroalkyl and polyfluoroalkyl substances (PFAS). The lawsuits allege that the companies knew about the health risks of PFAS but continued to sell AFFF anyway. The lawsuits argue that the companies should be held responsible for the harm that AFFF has caused, including cancer, thyroid disease and other health problems.

The first AFFF lawsuit was filed in 2013. Since then, thousands of lawsuits have been filed against the companies that manufactured and distributed AFFF. The lawsuits have been consolidated into a multi-district litigation (MDL) in the District of South Carolina.

The MDL is still ongoing, and it is unclear how it will be resolved. However, the lawsuits have already significantly impacted the AFFF industry. In 2022, 3M, DuPont, and other companies agreed to pay $10.3 billion to settle water contamination claims filed by local water authorities and municipalities. This settlement is the largest ever settlement involving PFAS contamination.


The AFFF lawsuits are still ongoing and could lead to even larger settlements. The lawsuits are also raising awareness about the health risks of PFAS, and they are helping to push the government and businesses to take action to reduce PFAS exposure.
